Description of Artwork: Paintings containing images of nude men (although some did not contain nude images) in traditionally female poses, like reclining.



Description of Incident: The event organizer asked Louis Hill, the gallery owner, to remove the paintings that she considered inappropriate for a fundraising event to benefit foster children with HIV. Hill refused to remove the paintings but allowed Hollis to cover them with plastic sheets.



Results of Incident: All of Sherer's paintings were temporarily covered for the duration of the fundraiser, although several large photographs of female nudes were allowed to remain uncovered in an adjoining gallery.

Description of Artwork: Any information that is ethnic, religious, racial, or political in origin, or is "patently false," that may incite hatred toward the CPA or is considered by U.S. authorities to undermine the process toward self government in occupied Iraq.



Description of Incident: Since April 2003 the United States has been regulating content on the IMN, restricting speech that is considered to impede the United States rehabilitation of the war torn state. The CPA director, L Paul Bremer III, has become the principle decision-maker in regard to the network's content, and maintains the power to hire and fire IMN staff.



Results of Incident: Control of the IMN by the occupational forces, resulting in the denial of free expression in Iraqi media.

Date of Action: Bonnell's suspension lasted fom June 16, 2003 until August 16, 2003 for his classroom interpretation of James Joyce's "The Boarding House." Bonnell had been in dispute with MCC over his use of language in the classroom several times since 1998.

Specific Location: Macomb Community College, Macomb County, Michigan.

Description of Artwork: A passage from "The Boarding House" reads, "She knew he had a good screw for one thing and she suspected he had a bit of stuff put by."



Description of Incident: John Bonnell assigned "The Boarding House," to students in his MCC english class. The school's administration suspended Bonnell in response to a student's complaint about the Bonnell's interpretation of a passage in the story as relating to the sexual relationship between a man and woman in the story. Bonnell has been suspended several times by the school for similar reasons, relating to the professor's language in the classroom.



Results of Incident: Bonnell was suspended for 3 months without pay.

Description of Artwork: Fictional rape and murder of woman and other videos considered by the government to be obscene.



Description of Incident: The Justice Department charged Extreme Associates, a North Hollywood wholesaler of adult films, with violating federal obscenity laws. The allegation includes distribution of obscene materials over the Internet and distribution of DVDs across state lines in violation of federal law.



Results of Incident: Extreme Associates continue to sell videos from their website, including those alleged to be obscene by the government. William Lyon, executive director of the Free Speech Coalition, a trade group created to support the adult entertainment industry, vowed to "fight [the charges] all the way." Zicari and Romano face up to 50 years in prison and fines up to $2.5 million.

Description of Incident: Julia Rose had tour dates at Borders cancelled and her CDs pulled from the shelves following her statement that "George Bush has chicken legs."



Results of Incident: Borders canceled their contract with Julia Rose and removed her CDs from the store. Management claimed Julia's lack of appeal with local clientele in Virginia was the cause of the cancellation, although May Korsun, the marketing manager for Borders, cited Julia's "chicken leg" comment as the reason.

Description of Artwork: Websites deemed by the Indian government to promot hate, slander, defamation, gambliiing, racism, violence, terrorism, pornography, child pornography, and violent sex.



Description of Incident: The Indian government passed a law enabling it sweeping authorization to police the internet. The order- No. GSR629(E)- equates the monitoring of the internet with balancing the flow of information and specifically denies any allegation of censorship. However, the law grants many agencies such as teh state home departments, the courts, police etc. to submit complaints regarding any website to an Information Technology department of the government, which then makes a spot decision to block out the site. There is no hearing process for the web designer, and the Information Technology department's decision is final.



Results of Incident: The law is currently in place and the screening process is ongoing.

Name: Artist Refuse to Pays Penance to Polish Govt. for her Religious Work Entitled "Passion"   [ Edit ]

Confronting Bodies: Regional Court in Gdansk, and the Polish penal code article 196.

Description of Artwork: The artwork entitled "Passion," depicts a cross, adorned with fragments of photographs depicting a male nude with exposed genitalia. Projected upon the cross and photographs is an image of a man's face contorted from the rigors of exercise.



Description of Incident: The piece was displayed in the experimental twenty-year-old Wyspa Gallery in Gdansk. Notoriety was created regarding the piece after it was aired on television, neither exhibiting the entire piece, nor giving the viewing audience an explanation of the artist’s intention. Political uproar ensued and Nieznalska was brought into court, accused of violating article 196 of the Polish penal code, which protects religious feelings. Also of note, the Polish constitution affords it's citizenry the right to free expression.



Results of Incident: Due to the exhibition, the court ordered the distinguished Wypsa Gallery to be closed. Further, Nieznalska was sentenced to six months community service, with concurrent restriction of creative expression, and was ordered to pay the trial fees. Nieznalska is fighting the decision and seeking an appellate review. Further, the Wyspa Progress Foundation is campaigning to overturn the verdict through circulating petitions, and applying political pressure to uphold the Polish constitution right to free expression.

Name: Mumbai International Film Festival Censors Indian Citizens   [ Edit ]

Description of Artwork: The MIFF is an international film festival which will be in it's eighth year of existence in 2004. The festival is a forum to promote the best work in a documentary format, with entries from across the world.



Description of Incident: The Ministry of Information & Broadcasting of India introduced a clause into the festival rules mandating Indian documentaries be pre-screened and, if necessary censored by the Ministry before their acceptance into the festival.



Results of Incident: Presently, (September 21, 2003) a petition is being circulated globally that supports a boycott a MIFF that requires governmental scrutiny and censorship prior to entry of Indian or any other national's entry. The initiative is entitled the "Campaign Against Censorship at MIFF 2004." These efforts come on the heels of six weeks of political action attempting to have the government rescind their mandate of censoring Indian filmmakers.

Name: Folk Dancing Quashed, Organizers Threatened.   [ Edit ]

Description of Artwork: Tradional Turkist folk dancing festival.



Description of Incident: Mustafa Hazer, the executive of ANKA Culture Centre, organized a folk dance performance planned for March 9th. On March 4th, Mustafa Hazer informed the governor's office regarding the planned festival. Then on March 5th, Mustafa was summoned into the Mersin security office, and threatened with imprisonment if he did not postpone the performance.



Results of Incident: The performance was postponed, Mustafa signed the requisite paperwork in fear of imprisonment if he did not comply.

Name: Diyarbakir National Education Directorate Cancels the Municipality City Theatre's Play.   [ Edit ]

Description of Incident: Diyarbakir National Education Directorate hindered the play titled "Gozort" and performed by Municipality City Theatre in January on the allegations that "it was not a children's play". Metin Boran, art director of the theatre stated that the play talked about the negative effects of advertisements on children and the directorate had hindered their plays before.

Description of Incident: Istanbul SSC ordered the confiscation of the book entitled "100 Sayida Dizisi-2 (In 100 Issues-2)" in January. The book was compilation of articles on death fast actions published in the journal Vatan .

The book "Parti ve Devrim Sehitleri Albümü (Party and the Album of Revolution Martyrs)" edited by Yildiz Göksu and Tuncay Deniz confiscated in January by Istanbul SSC on the grounds that the book contained propaganda for an illegal organization.

The 8th Chamber of the Court of Cassation confirmed the acquittal decision by Ankara Criminal Court No.2 in connection with the case of former judge Nurullah Aydin launched on the allegations that "he insulted the armed forces" in his book entitled "Her Sey Türkiye Için Milli Stratejik Konsept (Everything is for Turkey, National Strategical Concept)"

The book entitled "Göç, Rumlarin Anadolu'dan Mecburi Ayrilisi; 1919-1923 (Migration, Forced Departure of Anatolian Greeks from Anatolia)" published by Iletisim Publishing House was confiscated in January on the allegations that it contained "insults to Atatürk". Nihat Tuna, representative of Iletisim Publishing House and the translator of the book were also indicted.

Istanbul SSC reportedly launched an investigation in connection with a book entitled "Saklanmaya Çalisilan Bir Mesale Ibrahim Kaypakkaya" in February.

The novel named "Kasirga Taburu (Hurricane Battalion)" published by Aram Publishing House was confiscated by Istanbul SSC in February on the allegation that the book aimed at "aiding an illegal organization".

An officer charged at Ipsala Customs Gate reportedly hindered the sending of a book abroad on the allegations that it was "harmful" in Ipsala on 7 March. The book entitled "Barzani ve Kürt Ulusal Özgürlük Hareketi (Barzani and Kurdish National Liberation Movement)" on the life of Molla Mustafa Barzani, father of Mesut Barzani was published by Doz Publishing House. Bedri Vatansever, representative of the Can Printing House and Vahdettin Ince, translator were reportedly testified before the public prosecutor related to the book.

On 19 March, Istanbul Penal Court of First Instance No.2 started to hear the case of Ömer Faruk, administrator for Ayrinti publishing house and translator Kerim Sadi in connection with Marquis de Sade's book titled "Yatak Odasinda Felsefe (Philosophy in the Bedroom)". Ömer Faruk reminded that the book was translated to Turkish after 207 years of its publication. The hearing was adjourned to 4 June. Indictment wants the defendants to be sentenced according to Article 426 TPC (insulting the moral feelings of the people).

Istanbul SSC issued an order for confiscation of the book "Kina ve Ayna (Henna and Mirror)", written by Müslüm Yücel, on the grounds that it contained separatist propaganda on 28 March.



Results of Incident: Books confiscated, Judge acquitted, writers, translators and publishing houses indited and travel out of country impeded.

Name: Journalist Interviewing Militants in Turkey Sentenced to 15 Years In Prison   [ Edit ]

Description of Artwork: Memik Horuz held an interview with the militants of Workers' and Peasants Liberation Army of Turkey (TIKKO) in Tokat, excerps of which were published in "Özgür Gelecek."



Description of Incident: The Court of Cassation tried Memik Horuz the editor-in-chief of the journal "Isçi Köylü". Memik Horuz has been arrested since 25 June 2001 for an interview with the militants of Workers' and Peasants Liberation Army of Turkey (TIKKO) in Tokat. The interview that he allegedly conducted was not published in the journal "Isçi Köylü", but "Özgür Gelecek". In this connection the editor-in-chief of "Özgür Gelecek", Ali Kemal Kahraman, is on trial at Istanbul SSC.



Results of Incident: Memik Horuz was sentenced by Ankara SSC to 15 years' imprisonment on 12 June 2002 on charges of membership of an illegal organization.

Description of Incident: The public prosecutor in Beyoglu (Istanbul) indicted journalist Ahmet Kahraman in connection with an article published in the journal Özgür Gündem on 13 October 2002. Kahraman will be charged under Article 159 TPC with insulting Turkish identity. The trial will commence at the Beyoglu Penal Court of First Instance No.2.

Name: Banned Songs Played in Turkey Billions of Turkish Lire Levied in Fines   [ Edit ]

Description of Artwork: A song called "De Xalo" (Uncle), as well as 11 other non-disclosed songs.



Description of Incident: On 6 February, Diyarbakir Criminal Court No.2 continued to hear the case of the executives of the local TV station Gün TV in Diyarbakir. The court decided not to be responsible to hear this case. Television executives, Baki Demirhan, Nevzat Bingöl, Osman Özsat, Zafer Gür and Semsettin Yildirim were charged with insulting the armed forces (a violation of article 159 of the Turkish Penal Code) for playing the song "De Xalo" (Uncle) on 4 October 2001. The managing director Cemal Dogan was fined TL 34 billion 285 million because of 11 songs played on the station. The fine was reportedly due to violation of the Article 9/2 of the Law on Cinema, Video and Music Productions.



Results of Incident: Dogan the managing director of teh station stated that since the station had never received the list of banned songs from the Ministry of Culture, he would not pay the fine.
